Compensation
An employee is often compensated for in case of dismissal. In defining the compensation a formula is used determined by the cantonal judge. A x B x C determines the compensation.
A stands for the number of years in service. Half a year plus one day is rounded up. All the years till 35 count for half a year. The years from 35 till 45 count for 1 year. The years from 45 till 55 count for 1,5 year. Years from 55 for 2 years.
B stands for the wages. The gross wages per month, plus holiday allowance and more structural components like a 13th month, commission or fixed allowance at the end of the year.
C stands for the factor determined by the cantonal judge. It is used to express the degree to which party can be blamed for the dismissal, employer or employee. The factor runs from 0 till 2.
The compensation can be given in various ways. As wages or in some financial way at an insurance company or similar constructions. Be advised by a financial expert to see what construction may be best in your situation.
